The Right to Disconnect: What Changes from July 2026

Did you know that the right to disconnect became a legal obligation in Luxembourg? Since 4 July 2023, companies whose employees use digital tools for work purposes must have a scheme in place to protect this right. From July 2026, the deadline runs out: companies that have not put the necessary measures in place face administrative fines of up to €25,000, issued by the Director of the Inspection du Travail et des Mines (ITM).

So, do you feel your employer has properly put in place the tools needed to respect your right to disconnect as an employee?

  • You don’t have a right to disconnect charter at your company? Your employer has only a few days left to put one in place. Talk to your delegates — they can raise the matter directly with management, using the model and support provided by ALEBA.
  • You have a charter, but it isn’t really respected? A charter on paper isn’t the same as a charter that’s actually applied. If you’re still expected to answer messages at 10pm or during your holidays, your delegation can step in to demand it be properly enforced, or revised.
  • You have a charter, but it feels vague or insufficient? We’ve seen charters that are three lines long and don’t say much at all. If yours feels too vague to actually protect you, it’s worth having it reviewed — don’t hesitate to come back to ALEBA for our expertise.

In all three cases: send your delegates our way. ALEBA reviews existing charters, helps draft or strengthen them, and also offers its own model as a starting point, or as a basis for improving a charter already in place.
